Terms & Conditions

These Terms & Conditions govern the use of the reward platform 'Questify' (questify.tv), operated by Pascal Jeising, c/o MDC#753, Welserstraße 3, 87463 Dietmannsried, Germany (hereinafter 'Questify' or 'Operator'). By registering, the user accepts these Terms in their current version.

Questify is a digital reward platform where users earn virtual points called 'Gems' by completing offers (app downloads, in-app tasks, surveys, subscriptions, etc.).

Offers are provided by third-party providers (ad networks, market research companies). Questify acts as an intermediary and is not a contractual party to the individual offers. There is no legal entitlement to a specific number or type of offers.

3.1 Use of Questify requires free registration. There is no legal right to registration.

3.2 Users must be at least 18 years of age. By registering, users confirm they meet this requirement.

3.3 Only one account per person, household, IP address, and device is permitted. Multiple registrations are prohibited.

3.4 Users must provide truthful and complete information during registration and keep it up to date.

3.5 Login credentials must be kept confidential. Questify is not liable for damages caused by unauthorized use of an account by third parties.

4.1 Gems are virtual points valid exclusively on the Questify platform. They are not legal tender, have no standalone monetary value outside the platform, and cannot be sold, transferred, or inherited.

4.2 Gems are only credited after confirmation by the respective third-party provider. There is no entitlement to credit before such confirmation.

4.3 Questify reserves the right to cancel or permanently withhold Gems obtained through fraud, manipulation, or abuse. No refund or compensation claims arise.

4.4 Unclaimed Gems on accounts inactive for more than 24 months may expire after prior email notification.

5.1 Once the minimum balance shown on the Wallet page is reached, users may request a payout.

5.2 Questify processes payout requests within a maximum of 2 business days. No specific processing time is guaranteed.

5.3 Questify covers all payout fees, including any PayPal transaction fees. Users receive the full payout amount with no deductions.

5.4 During an active fraud investigation, payouts may be withheld until the review is complete. The user will be notified.

5.5 Completed payouts are non-refundable unless an incorrect transfer is demonstrably established.

The following actions are strictly prohibited and may result in immediate permanent account suspension and forfeiture of all pending Gems:

• Using a VPN, proxy, emulator, or other means to conceal actual location or identity
• Creating multiple accounts (more than one per person, device, or IP address)
• Completing the same offer more than once
• Manipulating click, install, or conversion data
• Using automated bots, scripts, or automation tools
• Attempting fraud against third-party providers at Questify's expense
• Sharing account credentials with third parties
• Any other form of fraud, manipulation, or abuse of the platform

7.1 Questify may suspend or delete user accounts at any time without prior notice, particularly in cases of suspected fraud, breach of these Terms, or at the justified request of third-party providers.

7.2 In the event of proven or strongly suspected fraud, Questify may permanently withhold all pending and credited Gems. No refund or compensation claims arise.

7.3 Users may terminate their account at any time by written notice to support@questify.tv. Pending Gems should be redeemed prior to termination; otherwise they are forfeited.

7.4 In case of suspension or termination due to violations, any remaining Gem balance is forfeited without compensation.

8.1 Questify is not liable for damages arising from temporary platform unavailability, technical disruptions, or third-party actions.

8.2 Questify assumes no liability for the content, quality, availability, or security of third-party offers.

8.3 Questify's liability is limited to intent and gross negligence unless mandatory law requires otherwise.

8.4 Questify is not liable for loss of Gems due to user error, device loss, or unauthorized account access by third parties.

Personal data is collected and processed in accordance with the Privacy Policy at questify.tv/datenschutz and in compliance with the General Data Protection Regulation (GDPR) and applicable national law.

10.1 Questify may modify these Terms at any time. Material changes will be communicated by email or prominent platform notice at least 14 days before taking effect.

10.2 If the user does not object in writing within 14 days, the updated Terms are deemed accepted.

10.3 In the event of objection, Questify may terminate the account. Legitimate pending payouts are not affected.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction for disputes with merchants or users without a domestic place of jurisdiction is Dietmannsried (Bavaria), Germany.

Should any provision of these Terms be wholly or partially invalid or unenforceable, the remaining provisions remain in force. The invalid provision shall be replaced by an enforceable provision that most closely reflects its intended economic purpose.
